END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legally binding agreement between you (“User,” “you”) and Mojave Repeater LLC (“Company,” “we,” “us,” or “our”) governing your access to and use of the software, applications, plugins, services, documentation, updates, and related materials provided by Company (collectively, the “Software”).

By downloading, installing, accessing, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not use the Software.

1. LICENSE GRANT

Subject to your compliance with this Agreement, Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software solely for your internal or authorized business or personal purposes.

The Software is licensed, not sold.

2. LICENSE RESTRICTIONS

You may not, directly or indirectly:

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software
Modify, adapt, translate, or create derivative works of the Software
Circumvent, disable, or interfere with license enforcement, security features, or access controls
Copy, distribute, sublicense, rent, lease, sell, or transfer the Software to any third party
Use the Software in violation of applicable laws, regulations, or third-party rights
Use the Software in any safety-critical, life-critical, or mission-critical environment where failure could result in injury, death, or property damage, unless expressly authorized in writing by Company

3. OWNERSHIP & INTELLECTUAL PROPERTY

The Software and all intellectual property rights therein are and shall remain the exclusive property of Company and its licensors.

This Agreement does not grant you any ownership rights in the Software.

4. THIRD-PARTY COMPONENTS

The Software may interface with, depend upon, or include third-party software, services, hardware, or platforms. Company does not control and is not responsible for third-party components, which are governed by their own terms and licenses.

5. NO RELIANCE OR GUARANTEES

You acknowledge that:

Software systems may experience errors, downtime, data loss, latency, or failures

Outputs, results, or communications produced by the Software are not guaranteed to be accurate, complete, or timely

You are solely responsible for verifying results and maintaining appropriate backups and safeguards

6. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

IN NO EVENT SHALL COMPANY’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS (USD $100), WHICHEVER IS GREATER.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Company and its officers, directors, employees, and agents from any claims, damages, liabilities, losses, or expenses arising from:

Your violation of this Agreement

Your violation of applicable laws or third-party rights

9. TERMINATION

This Agreement remains in effect until terminated.

Company may terminate this Agreement immediately upon notice if you breach any provision. Upon termination, you must cease all use of the Software and destroy all copies in your possession or control.

10. UPDATES & MODIFICATIONS

Company may provide updates, patches, or changes to the Software at its discretion. This Agreement applies to all updates unless otherwise stated.

Company may modify this Agreement at any time. Continued use of the Software constitutes acceptance of the revised Agreement.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of $Y o u r St a t e / J u r i s d i c t i o n$ , without regard to conflict-of-law principles.

12. SEVERABILITY

If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.

13. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and Company regarding the Software and supersedes all prior agreements or understandings.
